HOMEOWNERS ARBITRATION


How to Apply for Homeowners Arbitration
  1. After the parties have attempted to resolve the matter informally and the Petitioner has provided the opposing party with all reasonably requested information, the Arbitration Secretary will schedule a hearing and mail you the date, time, and place the hearing will be held. A postponement will be granted only for an extreme emergency. Postponements can be granted by the Arbitration Secretary.

  2. The fee for filing arbitration is $30. Check or money order payable to: "Delaware Insurance Department" must accompany the form. Your filing fee may be reimbursed as part of the Panel's decision.

  3. The enclosed Petition and three copies along with the supporting documentation must be returned to the Delaware Insurance Department, 841 Silver Lake Boulevard, Dover, DE 19904. The petitioner shall at the same time send a copy of the same Petition and supporting documents to the insurer or insurer's representative.

  4. Each Panel shall consist of three members of suitable backgrounds or experience. Each Panel shall have a presiding member who shall be appointed by the Commissioner.

  5. Please be sure the attached Petition for Arbitration is as complete as possible and is received by the Insurance Commissioner within 90 days from the date an offer of settlement or denial has been made by an insurer.
