How to Apply for Automobile Arbitration
  1. The fee for filing arbitration is $30.00.  A check or money order made payable to "Delaware Insurance Department" must accompany the form.

  2. The enclosed Petition must be returned to the above address along with four copies of the supporting documentation.  The Claimant shall at the same time send a copy of the Petition and the supporting documents to the insurer or insurer’s representative.  Please provide a brief statement verifying that copies have been sent to the opposing party.

  3. The Automobile Arbitration Panel consists of one Delaware attorney and two insurance adjusters appointed by the Insurance Commissioner.  The hearings are conducted in an informal manner and you do not need to retain an attorney.

  4. Upon receiving your request for arbitration along with your $30.00 fee for filing, the Arbitration Secretary will notify you of the date, time and place the hearing will be held.  A postponement will be granted only for an extreme emergency.  The Arbitration Secretary can grant postponements.

  5. Please be sure the arbitration form is as complete as possible and is returned within the two-year statute of limitations period.  The statute of limitations runs from the date of your accident.
